Saudi Foreign Ownership in 2026: The Law, the Zones, the Fees and the Data Still Missing

The law took effect in January 2026 and the Executive Regulation, approved in June and published in July, named the zones and set a 2% fee in four cities. The rules are now clear; an official count of foreign buyers is not.

    Saudi Arabia's Law of Real Estate Ownership by Non-Saudis, issued by Royal Decree M/14 on 14 July 2025, entered into force on 22 January 2026. It replaced the 2000 framework with a zone-based system. For five months, the market then waited for the two documents that decide where and how a non-Saudi can actually buy. On 23 June 2026, the Council of Ministers approved both: the Executive Regulation and the Geographic Scope Document. The regulation was published in the official gazette, Umm Al-Qura, on 3 July 2026.

    This article sets out what is now settled, what it costs, and what the official record still does not show.

    Where non-Saudis can buy

    Ownership is confined to approved zones, with narrow exceptions. The zones approved in June cover parts of Riyadh, Jeddah, Makkah, Madinah and AlUla, three giga-projects (NEOM, AMAALA and the Red Sea) and special economic zones in Jazan, Ras Al-Khair and King Abdullah Economic City.

    • Riyadh: nine sites: King Abdullah Financial District, Diriyah Gate, New Murabba, Qiddiya, King Salman Park, Sedra, King Salman International Airport, the Sports Boulevard and Arts District, and a transit-oriented development project.
    • Jeddah: the largest allocation, covering Jeddah Central and 55 numbered development areas across the governorate.
    • AlUla: 17 numbered areas.
    • Makkah and Madinah: named districts and projects only. Individual ownership is limited to Muslims, while Saudi companies with non-Saudi shareholders may also own within the approved zones.

    Two routes sit outside the map. Under Article 2 of the law, a non-Saudi legally resident in the Kingdom may own one residential property for their own use outside the zones, except in Makkah and Madinah. Under the Executive Regulation, an unlisted Saudi company with non-Saudi shareholders needs prior Ministry of Investment approval to own property outside the zones for its business or to house its staff.

    What it costs, and what buyers need

    The law allows REGA to levy a fee of up to 5% on the value of real estate dispositions by non-Saudis. The Executive Regulation set it at 2% for all types of real rights in Riyadh, Makkah, Madinah and Jeddah Governorate. The fee is separate from the 5% Real Estate Transaction Tax, which applies to every property transfer, Saudi or non-Saudi, and which ZATCA's guidance makes payable by the seller. REGA's own guidance puts the statutory ceiling for the two combined at 10%; under the current rules they total 7% of the transaction value in those four cities, although they do not necessarily fall on the same party. The regulation zero-rates certain cases, including inheritance divisions, transfers under court orders and expropriation for public benefit.

    Penalties are set in the law: fines of up to 5% of the value of the right concerned, capped at SAR 10 million, and, for misleading information, possible sale of the property at public auction. The regulation adds a graded table of violations.

    The paperwork is now explicit. Non-resident individuals need a digital identity issued by the Ministry of Interior, a Saudi bank account and a Saudi mobile number in their own name. Foreign companies must register with the Ministry of Investment, disclose their direct and indirect owners and open a local account, and must report any transfer of 5% or more of their ownership within 15 days. Applications, payment and title issuance run through REGA's Saudi Properties platform; mortgage finance stays with lenders licensed by the Saudi Central Bank.

    The map is published. What the official record does not yet show is how many foreign buyers have used it.

    What is still unknown

    As of mid-August 2026, REGA had not published a count of foreign applications or completed foreign transactions, and no official breakdown of property transfers by buyer nationality was available. In August, REGA described the geographic scope as a regulatory tool that can be revisited after internal review, but gave no timetable for widening it. It said it will judge the first year on platform efficiency, protection of rights, market attractiveness and investment indicators, not on transaction volume alone.

    The regime opens into a slower market. Ministry of Justice data show Saudi property transactions worth SAR 82.2 billion in H1 2026, down 51.5% year on year, while GASTAT's Real Estate Price Index rose 1.3% in Q2 2026. Three official signals will show whether the new framework converts into volume: the first foreign-ownership data from REGA or the Real Estate Registry, any revision of the zone map, and any change to the fee schedule outside the four cities.

    أين يحق لغير السعوديين الشراء

    يقتصر التملك على النطاقات المعتمدة، مع استثناءات محدودة. وتشمل النطاقات التي أُقرت في يونيو أجزاء من الرياض وجدة ومكة المكرمة والمدينة المنورة والعلا، وثلاثة مشاريع كبرى هي نيوم وأمالا والبحر الأحمر، إضافة إلى المناطق الاقتصادية الخاصة في جازان ورأس الخير ومدينة الملك عبدالله الاقتصادية.

    • الرياض: تسعة مواقع هي مركز الملك عبدالله المالي، وبوابة الدرعية، والمربع الجديد، والقدية، وحديقة الملك سلمان، وسدرة، ومطار الملك سلمان الدولي، والمسار الرياضي وحي الفنون، ومشروع للتطوير الموجه نحو النقل.
    • جدة: الحصة الأكبر، وتشمل وسط جدة و٥٥ منطقة تطوير مرقمة في أنحاء المحافظة.
    • العلا: ١٧ منطقة مرقمة.
    • مكة المكرمة والمدينة المنورة: أحياء ومشاريع مسماة فقط، ويقتصر تملك الأفراد فيها على المسلمين، فيما يحق للشركات السعودية التي يشارك في ملكيتها غير سعوديين التملك داخل النطاقات المعتمدة.

    ويبقى مساران خارج الخريطة. فبموجب المادة الثانية من النظام، يحق لغير السعودي المقيم في المملكة إقامة نظامية تملك عقار سكني واحد لسكنه خارج النطاقات، باستثناء مكة المكرمة والمدينة المنورة. وبموجب اللائحة التنفيذية، تحتاج الشركة السعودية غير المدرجة التي يشارك في ملكيتها غير سعوديين إلى موافقة مسبقة من وزارة الاستثمار لتملك عقار خارج النطاقات لمزاولة نشاطها أو لسكن موظفيها.

    الكلفة ومتطلبات المشتري

    يجيز النظام للهيئة العامة للعقار استيفاء رسم على قيمة تصرفات غير السعوديين العقارية لا يتجاوز ٥٪ من تلك القيمة، وحددته اللائحة التنفيذية بنسبة ٢٪ على جميع أنواع الحقوق العينية في الرياض ومكة المكرمة والمدينة المنورة ومحافظة جدة. ويُستوفى هذا الرسم بمعزل عن ضريبة التصرفات العقارية البالغة ٥٪، التي تسري على كل نقل للملكية سواء كان أطرافه سعوديين أو غير سعوديين، ويلتزم البائع بسدادها وفق أدلة هيئة الزكاة والضريبة والجمارك. وتحدد إرشادات الهيئة العامة للعقار السقف النظامي للعبئين مجتمعين بـ١٠٪، فيما يبلغ مجموعهما وفق القواعد الحالية ٧٪ من قيمة التصرف في المدن الأربع، وإن كانا لا يقعان بالضرورة على الطرف نفسه. وتطبق اللائحة نسبة صفرية على حالات بعينها، منها قسمة التركات، والتصرفات المنفذة بموجب أوامر قضائية، ونزع الملكية للمنفعة العامة.

    أما العقوبات فيحددها النظام: غرامات تصل إلى ٥٪ من قيمة الحق العيني محل المخالفة بحد أقصى ١٠ ملايين ريال، مع إمكانية بيع العقار بالمزاد العلني في حال تقديم معلومات مضللة. وتضيف اللائحة جدولاً متدرجاً لتصنيف المخالفات.

    وباتت الإجراءات محددة بوضوح. إذ يحتاج الأفراد غير المقيمين إلى هوية رقمية تصدرها وزارة الداخلية، وحساب مصرفي في المملكة، ورقم جوال سعودي باسمهم. وعلى الشركات الأجنبية التسجيل لدى وزارة الاستثمار، والإفصاح عن ملاكها المباشرين وغير المباشرين، وفتح حساب محلي، والإبلاغ خلال ١٥ يوماً عن أي انتقال لملكية نسبته ٥٪ أو أكثر. وتُنجز الطلبات والسداد وإصدار الصكوك عبر منصة «عقارات السعودية» التابعة للهيئة، فيما يبقى التمويل العقاري لدى الجهات المرخصة من البنك المركزي السعودي.

    الخريطة منشورة، لكن السجل الرسمي لا يكشف بعد عدد المشترين الأجانب الذين استفادوا منها.

    ما لا يزال مجهولاً

    حتى منتصف أغسطس ٢٠٢٦، لم تنشر الهيئة العامة للعقار عدد طلبات التملك المقدمة من غير السعوديين أو الصفقات المكتملة، ولم يتوفر تصنيف رسمي لعمليات نقل الملكية بحسب جنسية المشتري. وفي أغسطس وصفت الهيئة النطاق الجغرافي بأنه أداة تنظيمية يمكن مراجعتها بعد تقييم داخلي، من دون أن تحدد جدولاً زمنياً لتوسيعه، وأوضحت أنها ستقيس نجاح العام الأول بكفاءة المنصة وحماية الحقوق وجاذبية السوق ومؤشرات الاستثمار، لا بعدد الصفقات وحده.

    ويأتي النظام في سوق أبطأ إيقاعاً. فبيانات وزارة العدل تُظهر أن قيمة الصفقات العقارية في المملكة بلغت ٨٢٫٢ مليار ريال في النصف الأول من ٢٠٢٦، بتراجع ٥١٫٥٪ على أساس سنوي، فيما ارتفع الرقم القياسي لأسعار العقارات الصادر عن الهيئة العامة للإحصاء ١٫٣٪ في الربع الثاني من ٢٠٢٦. وثلاث إشارات رسمية ستكشف ما إذا كان الإطار الجديد سيتحول إلى حجم تداول فعلي: أول بيانات عن تملك غير السعوديين تصدرها الهيئة أو السجل العقاري، وأي مراجعة لخريطة النطاقات، وأي تعديل على جدول الرسوم خارج المدن الأربع.
