Kuwait's long-awaited mortgage reform has cleared the Cabinet. On 22 September 2026 ministers approved a draft decree-law on mortgage financing for housing-welfare beneficiaries and referred it to the Amir for consideration. It arrives after a record 2025 for registered property sales and in the middle of a noticeably slower 2026.

    What the Cabinet approved

The draft decree-law runs to 15 articles. It allows eligible citizens to finance the purchase of a home from a developer operating under Law No. 118 of 2023, the law on companies that build and develop residential cities, or to build on a plot allocated by the State. Beneficiaries must meet the Kuwait Credit Bank's loan conditions and must not have received state housing welfare before.

Financing is repaid in equal monthly instalments over no more than 25 years. The State bears the interest or return on the supported portion, and the borrower pays on any unsupported portion. The two can be combined under rules set by the Central Bank of Kuwait.

The pressure behind the reform is the housing queue. The Public Authority for Housing Welfare counted 108,227 pending housing applications at the end of February 2026. The Cabinet presented the decree as a way to ensure a sustainable supply of adequate housing for citizens.

    A record 2025, a cooler 2026

Ministry of Justice registration data, as reported by the Kuwaiti press, put 2025 real estate sales at about KWD 4.419 billion, up 25.8% from KWD 3.512 billion in 2024. These totals exclude craft plots and the coastal strip. The second half carried the year at about KWD 2.564 billion, against KWD 1.855 billion in the first. Private housing accounted for about KWD 1.748 billion, investment property KWD 1.671 billion and commercial property KWD 952.8 million.

2026 has been slower. On the same Ministry basis, June sales were about KWD 321 million, down 9.2% on June 2025, and July sales about KWD 397.1 million, down 10.3% on July 2025. Private housing was the exception in July, up 17.6% year on year to about KWD 168 million, while investment property fell 27.5%.

Sources differ on July. The Ministry has posted two versions of its July report, at KWD 398.5 million and KWD 412.5 million, both including small craft and shop deals. We use the like-for-like series that matches the 2025 total.

The mortgage decree is a structural change; the 2026 slowdown is a cyclical one.

Land and ownership rules are shifting too

Law No. 126 of 2023 on combating the monopoly of vacant land, which the Constitutional Court upheld in November 2025, has imposed fees on undeveloped residential land since March 2026. Separately, a decree approved in 2025 allows listed companies, real estate funds and investment portfolios with non-Kuwaiti ownership to buy commercial and investment property, while private-housing land remains off limits to them.

    What to watch

The decree-law now awaits the Amir's decision, followed by implementing rules from the Central Bank of Kuwait and the Kuwait Credit Bank. The Ministry of Justice's next monthly reports will show whether private housing, the segment the mortgage framework targets, keeps outperforming the rest of the market.
